이용약관

제1조 (목적)

이 약관은 라라랜드맘(이하 “회사”)이 WEB-STUDIO by AVVM(이하 “서비스”)에서 제공하는 홈페이지 제작 서비스의 이용조건과 절차, 회사와 이용자의 권리·의무 및 책임사항을 정함을 목적으로 합니다.

제2조 (서비스의 내용)

회사는 이용자의 요구사항을 바탕으로 웹사이트를 제작하여 납품하는 접수형 제작 서비스를 제공합니다.

제3조 (약관의 효력과 변경)

이 약관은 서비스 화면에 게시함으로써 효력이 발생합니다. 회사는 관련 법령을 위배하지 않는 범위에서 약관을 변경할 수 있으며, 변경 시 적용일자와 변경사유를 명시하여 적용일 7일 전 (이용자에게 불리한 변경은 30일 전)부터 공지합니다.

제4조 (이용계약의 성립과 제작 절차)

1. 이용자가 상품을 선택하고 결제를 완료하면 이용계약이 성립합니다.
2. 결제 직후 안내되는 이메일로 요구사항(참고 사이트, 로고, 원하는 느낌, 자료)을 보내주시면 제작이 시작됩니다. 30분 통화로 대신하실 수도 있습니다.
3. 원페이지는 24시간, 브랜드 사이트는 3일 안에 실제 접속되는 첫 시안 링크를 전달합니다.
4. 수정 반영 후 이용자의 도메인으로 오픈하며, 소스와 관리 방법을 인계합니다.
5. 다음의 경우 회사는 제작을 거절할 수 있으며, 이 경우 결제금액을 전액 환불합니다.
   • 이용자가 제공한 자료에 대한 사용 권한이 확인되지 않는 경우
   • 법령을 위반하거나 타인의 권리를 침해할 우려가 있는 제작 요청
   • 회사의 제작 역량으로 구현이 불가능한 요청

제5조 (제공 시기와 지연)

제2조의 납기는 이용자가 요구사항과 자료를 모두 제출한 시점부터 기산합니다. 다음의 경우 납기가 연장되며, 회사는 그 사유와 새로운 예상 일정을 안내합니다.

• 이용자의 자료 제출이나 시안 회신이 지연되는 경우
• 초기에 합의한 범위를 벗어나는 요구사항이 추가되는 경우
• 도메인 이전이나 외부 시스템 연동이 이용자 측 사정으로 지연되는 경우

제6조 (수정의 범위)

1. 상품별 포함된 수정 횟수 내에서 문구·이미지 교체, 색상·간격 조정, 섹션 순서 변경 등을 무상으로 반영합니다.
2. 다음은 수정이 아니라 추가 제작에 해당하며, 별도 견적으로 진행합니다.
   • 페이지·섹션의 신규 추가
   • 디자인 콘셉트의 전면 변경
   • 새로운 기능(결제, 로그인, 예약 등)의 추가
3. 포함된 수정 횟수를 초과하는 경우 회수당 비용을 사전에 안내하고 동의를 받은 후 진행합니다.

제7조 (도메인 · 호스팅 · 외부 비용)

• 회사는 도메인 연결과 호스팅 셋업 작업을 제작비에 포함하여 제공합니다.
• 도메인 등록·갱신 비용은 이용자가 도메인 등록기관에 직접 부담합니다.
• 기본 호스팅은 회사가 셋업한 무료 등급으로 제공되며, 트래픽 증가 등으로 유료 등급이 필요해지는 경우 그 비용은 이용자가 부담합니다.
• 결제대행사 이용 수수료, 유료 폰트·이미지 라이선스, 외부 API 이용료 등은 이용자가 부담하며, 회사는 착수 전에 예상 항목을 안내합니다.
• 도메인과 호스팅 계정은 이용자 명의로 개설하는 것을 원칙으로 합니다.

제8조 (대금의 결제)

1. 결제는 회사가 지정한 결제대행사(포트원)를 통해 원화(KRW)로 이루어집니다.
2. 회사는 간이과세자로서 세금계산서를 발급하지 않으며, 신용카드 매출전표 또는 현금영수증으로 갈음합니다.
3. 이용자는 결제 전 상품 내용·가격·납기·포함 범위를 확인할 책임이 있습니다.

제9조 (청약철회 및 환불)

청약철회와 환불에 관한 사항은 환불·청약철회 정책에 따릅니다. 제작 착수 전에는 언제든 100% 환불됩니다.

제10조 (저작권과 결과물의 권리)

1. 납품이 완료되고 대금이 완납되면, 제작된 웹사이트의 디자인과 소스코드에 대한 이용 권리는 이용자에게 이전됩니다. 이용자는 이를 자유롭게 사용·수정·이전할 수 있습니다.
2. 다만 다음은 권리 이전 대상에서 제외되며, 이용자는 해당 제공자의 라이선스를 따릅니다.
   • 제3자의 유료 폰트, 스톡 이미지·영상, 아이콘, 플러그인
   • 회사가 여러 프로젝트에 공통으로 사용하는 내부 라이브러리 — 이 경우 회사는 이용자에게 영구적이고 비독점적인 사용권을 부여합니다.
3. 이용자가 제공한 로고·사진·문구 등의 권리는 이용자에게 있으며, 회사는 제작 목적 외에 사용하지 않습니다.
4. 회사는 납품된 사이트를 포트폴리오에 게재할 수 있습니다. 이용자가 원하지 않는 경우 알려주시면 게재하지 않습니다.

제11조 (이용자의 의무)

• 제공하는 로고·사진·문구·상표에 대한 사용 권한을 적법하게 보유할 것
• 사이트에 게재할 정보의 정확성을 확인할 것
• 사이트를 통해 상품을 판매하는 경우, 사업자 정보 표시 등 관련 법령상 의무는 사이트 운영자인 이용자가 이행할 것
• 인계받은 도메인·호스팅 계정의 접속 정보를 안전하게 관리할 것

제12조 (회사의 의무와 책임의 한계)

1. 회사는 합의된 범위 내에서 성실하게 제작하고 납기를 지키기 위하여 노력합니다.
2. 회사는 사이트의 방문자 수, 검색 순위, 매출 등 운영 성과를 보증하지 않습니다.
3. 납품 이후의 운영 책임은 이용자에게 있습니다. 무상 보수 기간이 지난 후의 장애 대응·콘텐츠 수정은 유지관리 계약 또는 별도 비용으로 진행합니다.
4. 회사는 이용자가 사이트를 운영하며 발생한 제3자와의 분쟁, 개인정보 처리에 관한 책임을 지지 않습니다.
5. 회사는 천재지변, 호스팅 사업자의 장애 등 회사의 통제를 벗어난 사유로 인한 지연이나 중단에 대하여 책임을 지지 않습니다.

제13조 (분쟁의 해결)

이 약관에 관한 분쟁은 대한민국 법을 준거법으로 하며, 회사의 주소지를 관할하는 법원을 제1심 관할 법원으로 합니다. 다만 이용자가 소비자인 경우 「민사소송법」상 소비자의 주소지를 관할하는 법원에 소를 제기할 수 있습니다.

분쟁이 원만히 해결되지 않는 경우 한국소비자원(www.kca.go.kr, 국번없이 1372) 또는 전자거래분쟁조정위원회(www.ecmc.or.kr)에 조정을 신청하실 수 있습니다.

제14조 (문의)

Terms of Service

Article 1 (Purpose)

These Terms govern the conditions and procedures for using the website production service (the “Service”) provided by Lalalandmam (the “Company”) as WEB-STUDIO by AVVM, and set out the rights, obligations and responsibilities of the Company and the user.

Article 2 (The Service)

The Company provides an order-based production service that builds and delivers a website according to the user's requirements.

Article 3 (Effect and amendment of these Terms)

These Terms take effect upon being posted within the Service. The Company may amend them within the limits of applicable law, and will give notice of the effective date and the reason for the amendment at least 7 days in advance (30 days where the change is unfavourable to users).

Article 4 (Formation of contract and production process)

1. A contract is formed when the user selects a product and completes payment.
2. Production begins once you send your requirements (reference sites, logo, desired feel, assets) to the email address provided immediately after payment. A 30-minute call may be substituted.
3. A live first-draft link is delivered within 24 hours for a one-page site and within 3 days for a brand site.
4. After revisions, the site is launched on your own domain, and the source and administration instructions are handed over.
5. The Company may decline production in the following cases and will refund the full amount:
   • Usage rights in the materials provided cannot be verified
   • The request would breach the law or infringe another party's rights
   • The request cannot be realised with the Company's production capability

Article 5 (Time of supply and delays)

The delivery times in Article 2 run from the point at which the user has submitted all requirements and assets. They are extended in the following cases, and the Company will advise the reason and the new expected schedule:

• The user's submission of assets or response to a draft is delayed
• Requirements are added beyond the scope initially agreed
• Domain migration or integration with an external system is delayed for reasons on the user's side

Article 6 (Scope of revisions)

1. Within the revision count included with each product, the Company makes changes such as replacing copy and images, adjusting colours and spacing, and reordering sections free of charge.
2. The following constitute additional production rather than revision and are quoted separately:
   • Adding new pages or sections
   • A complete change of design concept
   • Adding new functionality (payment, sign-in, booking and the like)
3. Where the included revision count is exceeded, the cost per further revision is advised in advance and proceeds only with your agreement.

Article 7 (Domain, hosting and third-party costs)

• The Company includes the work of connecting the domain and setting up hosting in the production fee.
• Domain registration and renewal fees are paid by the user directly to the registrar.
• Base hosting is set up by the Company on a free tier. Where a paid tier becomes necessary — for example because of traffic growth — the cost is borne by the user.
• Payment gateway fees, paid font and image licences, and external API charges are borne by the user; the Company advises the expected items before starting.
• Domain and hosting accounts are, as a matter of principle, opened in the user's own name.

Article 8 (Payment)

1. Payment is processed in Korean won (KRW) through the payment provider designated by the Company (PortOne).
2. The Company is a simplified taxpayer and does not issue tax invoices; a credit card sales slip or cash receipt is provided instead.
3. The user is responsible for reviewing the product description, price, delivery time and included scope before paying.

Article 9 (Withdrawal and refunds)

Withdrawal and refunds are governed by the Refund & Withdrawal Policy. A full refund is available at any time before production begins.

Article 10 (Copyright and rights in the deliverable)

1. Once delivery is complete and payment has been made in full, rights to use the design and source code of the website transfer to the user, who may use, modify and transfer them freely.
2. The following are excluded from that transfer, and the user is bound by the relevant provider's licence:
   • Third-party paid fonts, stock images and video, icons and plugins
   • Internal libraries the Company uses across multiple projects — for these the Company grants the user a perpetual, non-exclusive licence.
3. Rights in logos, photographs and copy provided by the user remain with the user, and the Company uses them only for the purpose of production.
4. The Company may feature the delivered site in its portfolio. Please let us know if you would prefer that we do not.

Article 11 (User obligations)

• Lawfully hold the usage rights to the logos, photographs, copy and trade marks provided
• Verify the accuracy of the information to be published on the site
• Where goods are sold through the site, comply with the statutory obligations of a site operator, including display of business information
• Keep the credentials of the handed-over domain and hosting accounts secure

Article 12 (Company obligations and limits of liability)

1. The Company will produce the site diligently within the agreed scope and endeavour to meet the delivery date.
2. The Company does not warrant operating performance such as visitor numbers, search ranking or sales.
3. Responsibility for operating the site after delivery rests with the user. Incident response and content changes after the free aftercare period are handled under a maintenance agreement or at additional cost.
4. The Company is not liable for disputes with third parties, or for personal data handling, arising from the user's operation of the site.
5. The Company is not liable for delays or interruptions caused by events beyond its control, including natural disasters and outages at the hosting provider.

Article 13 (Governing law and jurisdiction)

These Terms are governed by the laws of the Republic of Korea, and the court having jurisdiction over the Company's address shall be the court of first instance. Where the user is a consumer, an action may be brought in the court having jurisdiction over the consumer's address under the Civil Procedure Act.

Where a dispute is not resolved amicably, application may be made to the Korea Consumer Agency (www.kca.go.kr, 1372) or the E-Commerce Dispute Mediation Committee (www.ecmc.or.kr).

This is an English translation provided for convenience. In the event of any discrepancy, the Korean version prevails.
